ACCEPTANCE OF TERMS: By using this website, subscribing, downloading any files or purchasing any products from InStat Research, LLC, you signify your acceptance of these Terms and Conditions of use, which with the Privacy Policy and Disclaimer govern InStat Research relationship with you as a visitor, subscriber, user or customer of this website. InStat Research reserves the right to take action against you if you breach any of these Terms and Conditions.
RESTRICTIONS OF USE: This website contains material which is owned by or licensed to InStat Research, including but not limited to: software code, indicators, systems, strategies, passwords, methodologies, analysis techniques, trademarks, brand names, graphics, design, layout, look and appearance. If you purchase any materials from InStat Research you are expressly forbidden from sharing, distributing, transmitting, uploading, selling, licensing, white labeling, rebranding, reproducing, republishing or unlocking them.
REPLACEMENTS: If you purchase any software code, indicators, systems or strategies from InStat Research you are solely responsible for storing, backing up and safeguarding them and any associated passwords. InStat Research will not and is not obligated to provide any replacements at any time. If InStat Research does agree to provide a replacement then a service fee will be charged at the discretion of InStat Research
REFUNDS & RETURNS: In general, there are no refunds. InStat Research's products are fully electronic and once they have been downloaded there is no way of "returning" them. InStat Research will only consider a refund in exceptional circumstances, for genuine reasons and at our discretion.
COPYRIGHT & TRADEMARK: InStat Research expressly reserves all copyright and trademark in its website and in all material on its website. Any redistribution or reproduction of part or all of the contents in any form is prohibited other than the following: you may print or download to a local hard disk extracts for your personal and non-commercial use only; you may copy the content to individual third parties for their personal use, but only if you acknowledge the website as the source of the material; and You may only distribute charts and examples of the InStat Research indicators, systems and strategies if you acknowledge InStat Research. You may not, except with our express written permission, distribute or commercially exploit the content. Nor may you transmit it or store it in any other website or other form of electronic retrieval system.
UPDATES: This website, its contents and products will be updated from time to time. In particular, software code, indicators, systems and strategies are updated for new versions of charting software platforms. However, InStat Research reserves the right to cease updates of the website, its contents and products at any time without notice.

EXCLUSION OF UNENFORCEABLE TERMS: Where any clause or term above would by any applicable statute be illegal, void or unenforceable in any State or Territory then such a clause shall not apply in that State or Territory and shall be deemed never to have been included in these Terms and Conditions in that State or Territory. Such a clause if legal and enforceable in any other State or Territory shall continue to be fully enforceable and part of this agreement in those other States and Territories. The deemed exclusion of any term pursuant to this paragraph shall not affect or modify the full enforceability and construction of the other clauses of these Terms and Conditions.

JURISDICTION: This agreement and this website are subject to the laws of the State of Oregon.
